Whether you’re new to the absence industry or looking for a refresher, the 2019 DMEC Compliance Conference preconference webinar will prepare you to tackle the nuts and bolts of the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA). Join us for a two-hour deep dive into the critical components of these laws. We will discuss the basics of FMLA and how to operationalize them in your organization, and also tackle the intricacies of ADA requirements and implementation.

FMLA Basics – 12:00-1:00 pm

Although the FMLA was signed into law over 25 years ago, understanding its requirements can be overwhelming. This presentation will walk you through FMLA basics, and provide practical, best practices that you can use to effectively administer your FMLA program. Through real-life FMLA scenarios, the first hour of this preconference session will:

  • Provide an in-depth overview of the FMLA, discussing employer and employee obligations.
  • Identify common misconceptions and implementation pitfalls when administering the FMLA.
  • Help you better understand and manage intermittent leaves.
  • Provide tips on how to prevent employee abuse of FMLA leave.
ADA Basics – 1:30-2:30 pm

In the second hour of this preconference session, we will dissect the ADA’s fundamental requirements in a practical way, preparing you to confidently integrate ADA compliance into your organization. By navigating a model interactive process, we will discuss ADA requirements that continue to pose challenges for employers, including determining who has a disability, knowing when and how to request disability-related information, and deciding what accommodations are reasonable. We will help you build your ADA competence and confidence, discuss the low cost and high impact of providing accommodations, and offer best practices for building an inclusive workplace. During this session, we will:

  • Explore employer and employee obligations under the ADA.
  • Review common areas of confusion and misconception around the ADA.
  • Discover best practices for ADA administration.

Tracie DeFreitas
Lead Consultant
Job Accommodation Network

Tracie Defreitas is a lead consultant for the Job Accommodation Network (JAN), the leading national source of free, expert, and confidential guidance on workplace accommodations and disability employment issues. She is one of JAN’s most senior consultants and has been employed since 1994. Tracie has served in multiple roles during her tenure with JAN. She currently supports all specialty teams providing expert disability-related federal employment law and workplace accommodation consultation regarding a broad range of medical impairments and ADA issues.

Tracie is an experienced national speaker who specializes in ADA Title I compliance and the interactive accommodation process. As part of her tenure at JAN, Tracie recently served for four years as program manager for the Campaign for Disability Employment (CDE), an award-winning national public awareness campaign designed to promote employment opportunities for individuals with disabilities. She provided leadership, accountability, and management of resources necessary to fulfill the CDE’s mission and vision, and was responsible for engaging key national disability and business stakeholder groups in the effort.

At JAN, she has also served as senior sensory specialist, providing accommodation solutions for individuals with sensory, immunology, and endocrinology related limitations.

David Mohl
Principal
Jackson Lewis PC

David Mohl is a principal in the Atlanta, Georgia office of Jackson Lewis PC. His practice focuses on proactive and preventative advice and counsel, with an emphasis in the area of leave management, focusing on the Americans with Disabilities Act, Family and Medical Leave Act, paid sick leave, and related leave statutes and policies. Mr. Mohl has a wide range of labor and employment law experience, including disability leave management, wage and hour, discrimination, harassment, employment agreements, restrictive covenants, training, and workplace investigations.

Mr. Mohl brings a unique business perspective, having worked in the corporate legal departments for Fortune 500 companies. Prior to joining Jackson Lewis, he served as associate general counsel at a Fortune 300 global consumer packaged goods company where he was a member of the general counsel’s senior leadership team, and was responsible for the company’s global labor and employment, litigation, and privacy functions.  Prior to that, he served as senior counsel at a large global health service and insurance company where he provided legal counsel and strategic advice regarding all global employment matters. Mr. Mohl also served in a general counsel capacity for the company’s third-party leave administration business.

Mr. Mohl is a frequent speaker on legal developments under the ADA, FMLA, and other employment law issues.
