Post-Pandemic Compliance Tips

This issue marks the two-year anniversary of employers navigating complex COVID-19-related employment practice compliance issues including employee safety, paid and unpaid leave, and accommodations.

Workplace safety rules — once deemed largely irrelevant for predominantly office-based businesses — expanded in certain states and localities to require screening, testing, social distancing, masks, plexiglass shields, and dividers.

New leave requirements — paid and unpaid, temporary, and permanent — were created by Congress, state legislatures, local governing bodies, public health officials, governors, and mayors. A number of these laws require employers to pay for time missed due to various COVID-19 reasons, including testing, required quarantine, and caring for a child whose school or childcare was closed or switched to remote learning.
