The FMLA and Unplanned Intermittent Leave Challenge

Thirty years since its enactment, the 1993 federal Family and Medical Leave Act (FMLA) remains an implementation challenge for employers. Despite high awareness of the law, a recent Department of Labor (DOL) report1 shows that many employees do not fully understand its design and the protections it provides, and many employers struggle with FMLA administration and intermittent leave.

For example, more than half of employees polled1 believe the FMLA covers more situations than it does (including care for siblings or grandchildren with serious health conditions). This confusion is likely exacerbated by new state paid and unpaid leave programs, although it’s not a new issue.2
