9th Circuit: Deadlines Can’t Fall on Weekends

In Legras v. Aetna Life Insurance Company, the insurer was not allowed to strictly limit appeal of a plan decision to 180 days. For Andre LeGras, his 180th day to appeal fell on a Saturday. A federal district court accepted Aetna’s position that LeGras’ appeal was untimely because it was dated the following Monday, on day 182.
