- Recognize where state PFML programs and state military leave laws expand military-related leave beyond federal requirements, and determine when PFML runs concurrently with FMLA, supplements USERRA, or stands alone.
- Apply USERRA reemployment rules, including reporting-back timelines, the escalator principle for the reinstatement position, and continuation of health coverage during a period of service.
- Apply practical strategies for coordinating benefits and wage-replacement payments, tracking leave across overlapping entitlements, protecting employee privacy, and documenting leave decisions defensibly, whether administration sits in-house or with a third party.
