Overview

Welcome to the Disability Management Employer Coalition (DMEC). DMEC is the only association dedicated to providing focused education, knowledge, and networking for absence and disability professionals.

In this Privacy Statement we set forth DMEC’s Privacy Policy as to Personal Information which we collect from any of our websites (e.g. http://www.dmec.org), mobile apps or related online and offline services we offer (collectively “Services), or other DMEC Websites which link to this Privacy Statement from our site (collectively “DMEC Websites”) and through other sources.

“Personal Information” is any information that enables us to identify you, directly or indirectly, by reference to an identifier such as your name, identification number, location data, online identifier, or one or more factors specific to you. Personal Information excludes anonymous information or information that has the identity of an individual permanently removed.

Your use of the DMEC Services and/or provision of your Personal Information to DMEC constitutes your consent to the use, storage, processing, and transfer of that information in accordance with this Privacy Statement.

Who We Are

For the purposes of the General Data Protection Regulation 2016/679 (the “GDPR”), the Data Controller is the Disability Management Employer Coalition with a registered address at 5173 Waring Road, Suite 134, San Diego, CA 92120. DMEC is a nonprofit, mutual benefit corporation based in the United States.

Privacy Statement Updates

We will update this Privacy Statement from time to time. If we make any material changes to this Statement or the way we use, share, or collect Personal Information, we will notify you by revising the “Updated” date at the top of this Statement, prominently posting an announcement of the updates on the DMEC Websites, or sending an email notification.

Each time you use the DMEC Websites the current version of this Statement will apply. This Statement is applicable to all DMEC Website visitors and users.

Collection of Personal Information

Throughout the DMEC Websites, there are forms for visitors and members to request information and purchase/register for products and services. We use Personal Information from these forms to provide the products, promotional materials, or memberships that you request.

Forms on the DMEC Websites and Services that request financial information do so in order to bill you for products or services ordered. Unique identifiers (such as your email and password) are collected from website visitors to verify the user’s identity for access to restricted content or features on the DMEC Websites and Services.

What Information Do We Collect?

DMEC collects the following Personal Information:

1) Information You Give Us

You may provide Personal Information to us which may include your name, home and/or work email address, mailing address, phone number and/or cell phone number, your employer and job title, demographic information about you including number of years in the industry, certification designations, etc., and if you are making a purchase, your credit card information.

DMEC collects Personal Information in the following ways:

  • Memberships: You provide Personal Information such as full name, employer, mailing address, phone number, email address, job title and responsibilities, and other information when you join or renew your membership in DMEC through the DMEC Websites or through your employer on your behalf. Membership information will include financial information and information concerning the content and time of the purchase.
  • Demos & Interest Lists: You provide Personal Information such as full name, job title and company, email address, and country when you sign up for a product demo or request to be added to interest lists.
  • Registrations & Purchases: You provide the same type of Personal Information as noted above for memberships when you register for an event or make a purchase using the DMEC Websites. Purchase information will include financial information and information concerning the content and time of the purchase. Event registrations may also include information about dietary restrictions and required accommodations.
  • Certifications & Trainings: You provide the same type of Personal Information as noted above for purchases when registering for a certification or training. Once you begin your certification/training, Personal Information about progress and scores is collected as you progress and is used to determine certification and recertification eligibility.
  • Research & Surveys: When you participate in DMEC research activities we make ask for your Personal Information required to verify your qualifications for research and/or to conduct the research.
  • Events: DMEC may receive information about you when you participate in any events we
    host, organize or sponsor, both online (e.g. webinar) or offline (e.g. conferences).
  • Employment Applications: DMEC collected relevant Personal Information from job applicants, including resume or CV, and any other information required to verity qualifications for any available position.
2) Site Use Information

DMEC collects technical information each time a visitor accesses a DMEC Website, including IP address, browser type and version, time zone settings, location, browser plug-in types and versions, operating system, and platform type.

We may also collect information about your visit, including pages you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

This technical information helps us to understand what browsers we need to support, what sections of the DMEC Websites are most popular, and how many visitors come to our site(s). You do not have to register with DMEC Websites before we can collect this information.

3) Personal Data We Collect from Other Sources

We may receive information about you from publicly available and third-party databases or services that provide information about business professionals that we believe will help us provide products and services that may be of interest to you. We will obtain your consent before contacting you if required by the law of the country in which you are located.

How Do We Use Personal Information?

We use your Personal Information according to the terms of the Privacy Policy in effect at the time of our use. We will only process your Personal Information, including sharing it with third parties, where (1) the processing is necessary for the performance of a contract to which you are a part, (2) we are required by law, (3) processing is required to protect your vital interests or those of another person, or (4) processing is necessary for the purposes of our legitimate commercial interests, except where such interests are overridden by your rights and interests.

We use Personal Information for the following purposes:

1) Information You Give Us

We use the Personal Information you provide us:

  • To carry out our obligations arising from your membership and any other agreement entered into between you and DMEC
  • To update and renew your membership as required
  • To notify you about changes to your membership, related services/products, or to ask you to provide feedback
  • To provide you with the information, products, and services you request from us
  • To organize and deliver conferences, events, and education relevant to your job and subjects of interest
  • To respond to your questions and provide related member or customer services
  • To provide you, or permit selected third parties to provide you, with information about events, products, or services we feel may interest you, provided you have not opted out of receiving such information
  • To comply with all applicable laws or legal processes, including providing information on individual users to the appropriate governmental authorities where required by law enforcement or judicial authorities.

We may use and disclose non-personal, non-individual statistics or demographic information in aggregate form without restriction.

2. Site Use Information

We use Personal Information we collect about your use of the DMEC Websites:

  • To administer, protect, and improve the DMEC Websites (including troubleshooting, data analysis, testing, system maintenance, support, reporting, and hosting of data)
  • To perform statistical analyses of the collective characteristics and behavior of visitors to the DMEC Websites and to measure user interests regarding specific areas of the DMEC Websites
  • To report aggregate, anonymous data in annual reports as to the number of page views, downloads, etc. of specific areas of the DMEC Websites
3) Personal Data We Collect from Other Sources

We combine this information with information you give to us and information we collect about you. We use this information and the combined Personal Information for the purposes set out above (depending on the types of information we receive).

4. Certification/Training Information

We use Personal Information collected through DMEC certifications and trainings:

  • To send notifications/reminders on your progress and status in the certification/training
  • To provide information on professional development opportunities and other news and communications of interest
  • To request feedback or input on the certification/training
  • To list all individuals who have achieved a CLMS designation on the DMEC Websites and at DMEC conferences
5. Exceptions

On occasion DMEC collects Personal Information through the DMEC Websites & Services with the intent to afford a greater degree of privacy for such information than is otherwise set forth in this privacy policy. In those situations where DMEC does so, we will clearly disclose to you at the time we collect such information what degree of privacy will be afforded to the Personal Information collected at such time.

For example, DMEC may collect survey information where DMEC’s use of any Personal Information from that survey is more limited than the general DMEC Privacy Statement would otherwise allow; in such a case, DMEC will disclose the stricter privacy policy governing that survey information at the time such Personal Information is collected from the survey respondent.

Do We Share Information with Third Parties?

Personal Information collected through the DMEC Websites is generally collected and maintained solely by DMEC or its contracted vendors. We will only transfer your Personal Information to trusted third parties who provide sufficient guarantees with respect to the technical and organizational security measures governing the processing to be carried out and who can demonstrate a commitment to compliance with those measures.

We may share Personal Information to third parties in the following ways:

  • With partners, suppliers, and sub-contractors for the performance of obligations arising from your membership, or any other agreement we enter into with them or you or to provide you with the information, products, and membership services that you request from us
  • With analytics and search engine providers that assist us in the improvement and optimization of the DMEC Websites
  • With trusted third-party companies and individuals to help us provide, analyze, and improve the DMEC Websites and membership services (including but not limited to data storage, maintenance services, database management, web analytics, and payment processing)
Sharing Personal Information with Sponsors and Exhibitors

DMEC does not sell your Personal Information; however, as part of our obligations to sponsors and exhibitors, we may provide event attendee lists to sponsors and exhibitors, which include Personal Information.

How Do We Secure Your Personal Information?

The DMEC Websites have security measures in place to protect the Personal Information under our control. While we cannot guarantee that loss, misuse or alteration to data will not occur, we take reasonable precautions to prevent such unfortunate occurrences. Certain particularly sensitive information, such as your credit card number, collected for a commercial transaction is encrypted prior to transmission.

You are ultimately responsible for the security of your DMEC login credentials. You may not share your DMEC login credentials with colleagues so they can access content or features that are restricted to DMEC members only.

Hardcopy Personal Information provided to DMEC which is not converted to electronic media and hosted by DMEC will be subject to different security procedures than will stored electronic Personal Information. DMEC has security measures in place to protect against the loss, misuse, and alteration of your hardcopy Personal Information under our control.

Where and How Long Do We Store Your Personal Information?

DMEC stores your Personal Information, in a form which permits us to identify you, for no longer than is necessary for the purpose for which the Personal Information is processed. We may retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and rights, or if it is not technically reasonably feasible to remove it. Consistent with these requirements, we will try to delete your Personal Information quickly upon request.

The Personal Information provided to us is generally stored on servers located in the United States. If you are located in another jurisdiction, you should be aware that once your Personal Information is submitted through the DMEC Websites, it will be transferred to our servers in the United States and that the United States currently does not have uniform data protection laws in place.

How Are “Cookies” Used on DMEC Websites?

Like most businesses, we employ “cookies” on the DMEC Websites. When you first access the DMEC Websites, you will receive a message advising you that cookies are in use. By accepting the message and continuing to browse, you signify that you understand and agree to the use of these cookies.

You do not have to accept cookies and consent can be withdrawn at any time. You can change your browser settings to refuse or restrict cookies, and you may delete cookies after they have been placed on your device at any time. If you do not accept or delete our cookies, some areas of the DMEC Websites may not function properly.

Your Privacy Rights

Correction and Removal

If any of the information that DMEC has about you is incorrect, or you wish to have information (including Personal Information) removed from our records, you may do so through your DMEC account or by contacting us at info@dmec.org or 800.789.3632, ext. 101.

Opting Out

If you prefer not to receive any or all marketing messages from us or wish to be excluded from
inclusion on distribution lists, please let us know by accessing the unsubscribe link within any marketing message that you receive or by contacting us at info@dmec.org or 800.789.3632, ext. 101.

Your European Privacy Rights

For European Residents Only. If you are based in the European Union (EU), in certain circumstances, you have rights under the GDPR in relation to your Personal Information.

  • Request Access to Your Personal Information. You may have the right to request access to any Personal Information we hold about you as well as related information, including the purposes for processing the Personal Information, the recipients or categories of recipients with whom the Personal Information has been shared, where possible, the period for which the Personal Information will be stored, the source of the Personal Information, and the existence of any automated decision making.
  • Request Correction of Your Personal Information. You may have the right to obtain without undue delay the rectification of any inaccurate Personal Information we hold about you.
  • Request Erasure of Your Personal Information. You may have the right to request that Personal Information held about you is deleted.
  • Request Restriction of Processing Your Personal Information. You may have the right to prevent or restrict processing of your Personal Information.
  • Request Transfer of Your Personal Information. You may have the right to request transfer of Personal Information directly to a third party where this is technically feasible.

Where you believe that we have not complied with our obligations under this Privacy Policy or European data protection laws, you have the right to make a complaint to an EU Data Protection Authority, such as the UK Information Commissioner’s Office.

Your California Privacy Rights

For California Residents Only. Section 1798.83 of the California Civil Code requires select businesses to disclose policies relating to the sharing of certain categories of your Personal Data with third parties. If you reside in California and have provided your Personal Information to DMEC, you may request information about our disclosures of certain categories of Personal Information to third parties for direct marketing purposes.
