Compliance Memos_May 2019Untrained Manager Creates ADA Liability for Car Dealer

In Equal Employment Opportunity Commission v. Crain Automotive Holdings LLC, the employer argued it did not know employee Judith Vaughan had a disability, and therefore could not have fired her for that reason. Vaughan provided evidence to the contrary. After experiencing her first panic attack on a Monday, Vaughn provided doctors’ notes and other documentation to her supervisor throughout the week as her treatment progressed. Vaughan was terminated the following Tuesday after the employer allegedly stated “it was not working out” due to her health problems. The federal district court denied summary judgment for the employer, allowing the Americans with Disabilities Act (ADA) claim to go to trial.
