Should Employers Treat USERRA Like Any Other Short-Term Leave?

While the Uniformed Services Employment and Reemployment Rights Act (USERRA) does not require employers to pay for military leave, recent court activity suggests that this is an issue to watch according to legal experts during our annual compliance webinar series. Two federal courts of appeals cases — White v. United Airlines, Inc., et al.,and Travers v. Federal Express Corporation decided that if a company pays for other short-term leaves, such as jury duty, illness, and bereavement, it should also pay for military leave as well.  Learn more at www.fineos.com/blog/userra-covered-military-leave-may-now-become-paid-leave/.

“Path Out of the Pandemic” Requirements

President Biden released a “Path Out of the Pandemic” on Sept. 9 with a six-part approach that includes a vaccination requirement for any person who works for federal agencies including contractors and those who work remotely. The Plan, which is intended to vaccinate as many Americans as possible, also applies to employers with more than 100 employees. Business groups have asked the Biden administration to delay the mandate until after the holidays, an issue we will continue to watch.
