Understanding the intersection between leave, accommodation, and disability is critical to ensure employees receive their entitlements and/or benefits and to limit compliance risk for employers. Here are key steps to ensuring employees receive the appropriate entitlements and benefits.

Determining the Employee Worksite

Employees are often entitled to job-protected leave if they meet specific eligibility requirements for federal, state, or local laws. The first step is determining the employee worksite, which is defined by the federal Family and Medical Leave Act (FMLA), and work location for state and local leave and accommodation laws. Three eligibility requirements help determine eligibility for FMLA leave:
